in O.P.No.365 of 2012 P.T.ASHA, J., The above applications are filed to re-open the evidence of P.W.1 and to eschew the evidence of P.W.1 and to examine one N.Ramakrishnan, the deponent of the affidavit as P.W.1 in the place of Mr.P.Arangasamy, respectively.

2. In paragraph No.2 of the affidavit filed in support of the applications, the applicant has narrated as to why the above applications have been necessitated. The applicant would submit that Mr.P.Arangasamy, who had let in evidence had serious health issues and went on medical leave and resigned from the Corporation and in the meanwhile the Covid had also taken place. 1/3

3. Though the respondents would oppose the said application, however taking into consideration the valid reasons put forward in the affidavit filed in support of the above applications the applications are ordered as prayed for. It is made clear that the evidence of the petitioner shall be concluded within a period of one month from the date P.W.1 entering the box.

4. For continuing cross examination list the matter before the learned Master on 08.10.2020.
