Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records relating to the Letter No.2285/Appeals/PY 2015-2016 dated 09.06.2016 read with 3rd respondent promotion office order No.2533 dated October 09, 2015 and quash the letter dated 09.06.2016 and the promotion office order dated 09.10.2015 so far as respondents 5 to 7 are concerned and consequently direct the 3rd respondent, promote the petitioner to the post of General Manager (Grade E) from the dated of promotion of juniors as General Manager (Grade E) with all benefits including arrears of pay and allowance. In view of the fact that the respondent Bank has been privatised through proceedings dated 14.03.2019, the learned counsel for the petitioner seeks permission to withdraw the writ petition with liberty to approach the appropriate forum on the very same cause of action.

2. Accordingly, the writ petition is dismissed as withdrawn with liberty to the petitioner to avail the remedies otherwise available under law on the

very same cause of action. The periods spend before this court until the dispatch of this order shall stand excluded for all purposes, including limitation etc., No costs. Connected miscellaneous petitions, if any, shall stand closed.
