PRAYER: Writ Petition filed under Article 226 of Constitution of India praying to issue Writ of mandamus directing the respondents to admit the petitioner, Thendral.T, to the I year Bachelor of Fine Arts Course for the year 2015-16 in the Visual Communications Department of the 1st respondent College and pass such further orders. O R D E R
In pursuant to the submission made by the learned counsel for the petitioner, this Court has directed the learned Additional Government Pleader for the respondents to get instruction. Accordingly, today, when the matter is taken up, learned Additional Government Pleader produced a letter dated 13.08.2015 of the Principal, Government College of Fine Arts, Chennai. Relevant
portion of the said letter is extracted hereunder: "In the reference first cited above, it was requested to provide relevant records, para wise remarks and instructions regarding the above writ petition (W.P.No.24096/2015) filed by T.Thendral (Minor) Represented by N.Thiyagarajan. In the reference second cited above, it was informed that there is no possibility to provide a seat to the petitioner as the petitioner had not produced original Transfer Certificate as per the rules and regulations pertaining to admission procedures of the Government College of Fine Arts, Chennai.
In the reference third cited, it was informed that the above matter came up for hearing on 13.08.2015 and the Hon'ble Court has directed to get instructions regarding if there is any possibility to admit the petitioner Thendral Thiyagarajan in the first year of Bachelor of Fine Arts Course in Visual Communication Design for the year 2015-2016 and report the same on 14.08.2015. It is humbly submitted that a special seat has been created so as to enable the petitioner to get admitted into Bachelor of Fine Arts Course 1st year in Visual Communication Design for the year 2015-2016."
2. In view of the above said instruction, the writ petition stands disposed of by directing the respondents to admit the petitioner into the Bachelor of Fine Arts Course in the 1st year for the year 2015-2016.
