This Application has been filed seeking leave of this Court to institute a suit against the defendants under Section 92 of the Civil Procedure Code under the allegation that 3rd respondent herein who is a life trustee of the Trust seems to manage the properties of the Trust. An allegation has been made that 3rd respondent has transferred a sum of Rs.70,00,000/- (Rupees Seventy Lakhs only) to his Wife's account. Further, 3rd respondent seems to have also entered into a Joint Development of the Trust property with a third party without any Resolution of the Board Members of the Trust and had received a sum of Rs.25,00,000/- (Rupees Twenty Five Lakhs only) as an initial payment and the said third party also seems to have lodged a complaint as against 3rd respondent in that regard and the same has been produced before this Court as Plaint Document No.4.

2.Considering all these aspects prima facie, there seems to be serious allegations as regards the Management of the Trust. Hence, the leave as prayed for is granted and as a corollary, the Registry is directed to number the suit, if it is otherwise in order.
