ORDER
1. Heard.
2. This Transfer Civil Miscellaneous Petition has been filed seeking withdrawal of G.W.O.P. No.9 of 2025 pending on the file of the Principal District Court, Ranipet, and for transfer of the same to the file of the Principal Family Court, Coimbatore.
3. The petitioner would state that the marriage between the petitioner and the respondent was solemnized on 22.04.2015 and two female children were born out of the wedlock. The respondent has filed the guardianship proceedings in G.W.O.P. No.9 of 2025 and the minors are stated to be Yoshni (aged about 9 years) and Gopika (aged about 6 years).

The petitioner would submit that she is residing at Alandurai, Coimbatore District, along with the minor children and the children are studying at Thondamuthur Panchayat Union Middle School, Alandurai. It is her further case that she is depending on her sister and is earning only a meagre income.
5. The petitioner would submit that travel from Coimbatore to Ranipet is more than 832 kms (up and down) and she has no one to accompany her and the two minor female children and, therefore, she is put to grave hardship in 2/6
attending the proceedings at Ranipet. The petitioner would also refer to the pendency of an F.I.R. in Crime No.29 of 2023 under the POCSO Act on the file of Ranipet AWPS Police Station and state that the children are afraid to visit Ranipet.
6. This Court has considered the submissions and perused the materials. In transfer petitions arising out of matrimonial/guardianship proceedings, the convenience of the wife and the minor children, the distance involved, the attendant hardship and the interest of justice are relevant considerations. In the case on hand, the petitioner is stated to be residing at Coimbatore with two minor female children who are also studying there, and the distance to Ranipet is substantial. Having regard to the above circumstances, this Court is of the view that the petitioner has made out sufficient cause for transfer.
7. Accordingly, Tr.C.M.P.
No.436 of is allowed.
G.W.O.P. No.9 of 2025 on the file of the Principal District Court, Ranipet, is withdrawn and transferred to the file of the Principal Family Court, Coimbatore. The Principal District Court, Ranipet, shall transmit the entire records to the Principal Family Court, Coimbatore, within three (3) weeks from the date of receipt of this order and the Principal Family Court, 3/6
Coimbatore, shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order. Interim stay granted by this Court on 24.04.2025 shall stand vacated and C.M.P. No.10123 of 2025 is closed. There shall be no order as to costs. 08.01.2026 Index:Yes/No Internet:Yes dsn 4/6
