ORDER

This Criminal Original Petition has been filed seeking a direction to direct the Special Court for the exclusive trial of cases registered under SC/ST (POA) Act, Coimbatore, to consider the bail application of the petitioner on merits in connection with the case in Crime No.243 of 2026 on the file of the respondent police, on the same day of her surrender. 2.Heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor appearing for the first and second respondents.

3.It is seen from the records that victim is the grandfather of Sathiya, who is studying in the 11th standard. In the same class, one Dharun is also studying. Sathiya had complained to the school teacher stating that there was a mistake in the calculation of marks, based on which Dharun's marks sheet was corrected and his marks were reduced. Aggrieved by the same, Dharun abused Sathiya and informed his parents, who also abused the victim girl. Following the same, when Sathiya's grandfather was present, the petitioner, who is the mother of Dharun along with the others abused them in a public place by calling out their caste name and also assaulted them and caused grievous injuries. The second victim is a minor girl. Everything had happened in the public place and in

public view. Thereafter, the defacto complainant had admitted to the hospital. Intimation was sent from the hospital to the police and the police have registered case. Initially CSR No.290 of 2026 was assigned on 17.03.2026 and thereafter, after three days FIR in Crime No.243 of 2026 has been registered. 4.In view of the above factual position, there shall be a direction to the the Special Court for the exclusive trial of cases registered under SC/ST (POA) Act, Coimbatore, to consider the petitioner's bail application, preferably on the same day of his surrender, in connection with Crime No.243 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioner shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
