Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a writ of mandamus, directing the respondents to act upon the petitioner's applications dated 05.02.2024 and 14.10.2024 to survey and fix the boundaries for the petitioner's land viz all that punja land measuring 1 acre 89 cents, associated with Survey No.228 and covered by Patta No.409 and identify and fix the boundaries of the same.

ORDER
By consent of both parties, the present writ petition is taken up for final disposal at the admission stage itself.
2. The present writ petition is filed seeking a writ of mandamus to direct the respondents to act upon the petitioner's applications dated 05.02.2024 and 14.10.2024 to survey and fix the boundaries for the petitioner's land viz all that punja land measuring 1 acre 89 cents, associated with Survey No.228 and covered by Patta No.409 and identify and fix the boundaries of the same.
3. At the outset, it is submitted that the petitioner has taken out an application and has paid the appropriate survey fee as early as 04.10.2023. The learned Special Government Pleader for the respondents would submit that the survey would be carried out and a report would be submitted within a period of eight weeks from the date of receipt of a copy of this order. The same stands agreed to by the learned counsel for the petitioner.

In view thereof, the writ petition stands disposed of with the direction to the respondents to carry out a survey, place boundary stones and complete the process within a period of 8 weeks from the date of receipt of a copy of this order after giving prior notice to the petitioner, adjacent land owners and other interested parties including rival claimants if any. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law. There shall be no order as to costs.
