ORDER

The petitioner seeks transfer of MCOP.No.89 of 2022 pending on the file of the Motor Accident Claims Tribunal, Subordinate Court, Vaniyambadi, Thirupattur District, to the file of the Motor Accident Claims Tribunal,

The learned counsel for the petitioners submitted that the petitioners are permanent residents of Tiruvannamalai District and that the distance between their residence and the Motor Accident Claims Tribunal at Vaniyambadi is approximately 150 kilometres, making it extremely difficult for them to travel such a long distance on every hearing date, particularly when their personal presence is required. He further submitted that the petitioners belong to a poor family and earn their livelihood through daily wage work. The learned counsel also submitted that the accident occurred within Tiruvannamalai District, the jurisdictional police registered the case in Tiruvannamalai District, and the postmortem was conducted at the Government Hospital, Tiruvannamalai. Further, the entire cause of action arose within Tiruvannamalai District and all the material witnesses, including the police officials, medical personnel, eyewitnesses, and the owner of the motorcycle involved in the accident, are situated within Tiruvannamalai District. Therefore, it was

contended that the Motor Accident Claims Tribunal, Tiruvannamalai, would be the most convenient forum for effective adjudication of the claim petition.

3. On considering the submissions made by the learned counsel for the petitioners and on a perusal of the records, it reveals that the accident originally occurred at Tiruvannamalai. All the eyewitnesses are residents of Tiruvannamalai. Therefore, the petitioner seeks transfer of the case. Considering the hardship involved in producing the witnesses before the present Court, the reason stated for transfer appears to be justifiable.

4. Accordingly, M.C.O.P. No. 89 of 2022, pending on the file of the Motor Accident Claims Tribunal, Subordinate Court, Vaniyambadi, Tirupattur District, is transferred to the file of the Motor Accident Claims Tribunal,

5. The Motor Accident Claims Tribunal, Subordinate Court, Vaniyambadi, Tirupattur District, is directed to transmit the case records to the Motor Accident Claims Tribunal, Subordinate Court, Tiruvannamalai, within a period of three weeks from the date of receipt of a copy of this order.

6. Upon receipt of the records, the Motor Accident Claims Tribunal, Subordinate Court, Tiruvannamalai, shall issue notice to all the respondents and thereafter proceed with the matter in accordance with law and dispose of the same as expeditiously as possible, preferably within a period of four weeks from the date of receipt of the case records.
