Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents herein to consider the petitioner representation dated 25.02.2025 and to transfer the petitioner from Government Medical College Hospital, Ramanathapuram to post the petitioner in Primary health centre at Kanniyakumarii or Medical College Hosptial Aasaripallam Kanniyakumari or any other place of petitioner native in Government Hospital Kanniyakumari District or ESI Hospital Nithiraivenai Kanniyakumari.

ORDER

This Writ Petiton has been filed in the nature of a Mandamus seeking a direction against the respondents to consider the representation dated 25.02.2025, by which representation the petitioner sought transfer from Government Medical College Hospital, Ramanathapuram to the Primary Health Centre at Kaniyakumari or Medical College Hospital, Aasaripallam, Kanniyakumari or to any other place in Kanniyakumari District. 2.The petitioner is now working as Staff Nurse. She claims that owing to various reasons in the family, including the illness of her mother who is quite aged, she requires transfer from Ramanathapuram to any medical institution at Kanniyakumari District.

3.Instructions have been obtained on behalf of the respondents, wherein it had been stated that, as on date, no vacancy might arise in Kanniyakumari

District, consequent to promotion of Nursing Superintendent Grade-II. If that promotion takes place and a counselling is undertaken, then if vacancy arise in Kanniyakumari District for the post of Staff Nurse, the respondents, if the petitioner is otherwise eligible, may consider transferring the petitioner to any Hospital in Kaniyakumari District.

4.With the above observations, this Writ Petition stands disposed of. No costs.
