O R D E R
The petitioner has filed this Writ petition seeking issuance of a Writ of Mandamus to direct the 4th respondent to consider the online application dated 11.04.2023 and provide the Electricity Service Connection to the Petitioner's property.
2. Mr.L.Jaivenkatesh, learned Standing Counsel takes notice for the respondents. In view of the consent expressed by the Learned counsel appearing for either side, this petition is taken up for final disposal.
3. The case of the petitioner is that he claims to be the owner of the property situated at Door No.1, Perumal Kovil Street, Nerkundram, Chennai. The said property consists of two floors and each floor has separate service connection and the ground floor was rented out to a tenant by the petitioner's father in the year 1989. While such being the case, the petitioner's father received a notice dated 13.02.2013 issued by the 4th 2/7
respondent, demanding him to pay a sum of Rs.23,06,005/- for theft committed by the said tenant. Pursuant to the said notice, upon verification, the petitioner came to know about the above said alleged theft committed by the tenant. Thereafter, the 4th respondent again issued a notice dated 13.02.2013 to the petitioner's father to pay the demanded amount under the threat of disconnection of service connection. Aggrieved by the said notice, the petitioner's father filed a Writ petition in W.P.No.32216 of 2014 challenging the above said demand notices and this Court, vide order dated 21.04.2022 allowed the said Writ petition.
Pursuant to the order of this Court, the petitioner approached the respondents in person to obtain Service connection for the subject property and also made a representation before the 3rd respondent, which evoked no response. Therefore, the petitioner sent another representation dated 11.04.2023 to the respondents and also made an online application dated 11.04.2023, seeking to effect Service connection to the petitioner's premises, however, till date, no orders have been passed on the same. Hence, this Writ petition.
4. Though very many grounds have been raised, learned counsel for the petitioner submits that, it would suffice, if this Court issues direction to 3/7
the 4th respondent to consider the petitioner's representation dated 11.04.2023 and provide Service connection to the petitioner's premises as expeditiously as possible.
5. Learned Standing Counsel appearing for the respondents has no serious objection for the said order being passed.
6. Considering the limited request made by the learned counsel for the petitioner, this Court without expressing any opinion on the merits of the case directs the 4th respondent to consider the petitioner's representation dated 11.04.2023 on merits and in accordance with law and pass appropriate orders, within a period of three weeks from the date of receipt of a copy of this order, after affording an opportunity of personal hearing to the petitioner and aggrieved persons, if any.
7. Accordingly, this Writ petition stands disposed of. No costs. 27.04.2023 skt Speaking Order : Yes/ No Index : Yes/ No 4/7
