Defendants (2nd defendant is impleaded as per the order dt.24.11.2022 passed in A.No.4187 of 2022) PRAYER: Civil Suit is filed under Order IV Rule 1 of High Court O.S. Rules and Order VII Rule 1 of CPC praying:- 1/3

(a) for a direction to the defendant to pay a sum of Rs.4,59,77,323/- as on 14.05.2018 with interest at the rate of 18% per annum on the Principal sum of Rs.3,18,15,835/- from the date of plaint till the date of payment in full to the plaintiff; and (b) for the costs of the suit.

JUDGMENT

On account of liquidation of the defendant company, the learned counsel for the plaintiff seeks permission of this Court to withdraw the suit. She has also made an endorsement to that effect in the Court bundle. Accordingly, the suit is dismissed as withdrawn. Registry is directed to refund the court fees to the plaintiff.
