ORDER
The Writ Petition has been filed challenging the letter issued by the 1st respondent dated 05.01.2026.
2.The fact remains that the petitioner applied for passport. On receipt of the said application, the 1st respondent called for police verification report from the 3rd respondent. The 3rd respondent verified the same and had sent a report intimating the 1st respondent that the petitioner has involved in a criminal case registered in Crime No.23 of 2022, for the offences punishable under Sections 147, 269, 270, 294(b), 323, 353 and 506(I) I.P.C, under Section 3 of the Epidemic Diseases Act, 1897, and Section 51(a) and (b) of the Disaster Management Act, 2005.
3.On receipt of the said verification report, the 1st respondent issued a letter dated 05.01.2026, which is impugned in this Writ Petition, seeking clarification about the pendency of the criminal case. On receipt of the same, the petitioner did not even respond to the same and rushed to challenged it before this Court. Therefore, it is only a letter issued by the 1st respondent
seeking clarification with regard to the pendency of the criminal case. In fact, the 1st respondent once again has sent a letter dated 28.04.2026 seeking clarification whether the criminal case is still pending or closed. 4.In view of the above, this Court finds no infirmity or illegality in the letter dated 05.01.2026, issued by the 1st respondent, which is merely seeking clarification from the petitioner. Therefore, the Writ Petition itself is devoid of merits accordingly stands dismissed. However, the petitioner is granted liberty to respond to the clarification letter sent by the 1st respondent, within a period of two (2) weeks, from the date of receipt of a copy of this order. The 1st respondent, on receipt of the said clarification, can consider and dispose of the application submitted by the petitioner for issuance of passport within a period of four (4) weeks thereafter. No costs. Consequently, the connected WPMP.Crl.No.257of 2026 is closed.
