BHARATHA CHAKRAVARTHY CRIMINAL MISCELLANEOUS PETITION No.6998 of 2022 IN CRL.R.C.No.499 of 2022 RAJESWARI [ PETITIONER ] Vs THIRUMAL [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition that the petitioner has to pay Rs.2,00,000/- (50% of the Cheque amount) within four weeks from the date of receipt of copy of the order in Crl.M.P.No.5055 of 2022 in Crl.R.C.No.499 of 2022 dated 18.04.2022.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.S.NAGARAJAN, Advocate for the petitioner the court made the following order:- While granting suspension of sentence, this Court imposed the condition to deposit a sum of Rs.2 Lakhs. The petitioner has come up with the application by stating that she was unable to mobilize the amount within a period of four weeks and seeks a modification. 2.However, once the benefit of suspension of sentence is granted on the said condition, now, it cannot be modified. But, however, considering the request made by the learned counsel for the petitioner, time is extended further period of four weeks for making payment.

3.If the petitioner fails to comply, then the order of suspension of sentence shall stand vacated automatically and the other side shall have an opportunity to proceed further in the matter before the Trial Court for issuing of warrant and executing it, in accordance with law.
