Respondents Prayer: The Criminal Original Petition is filed under Section 482 of Cr.P.C. to pass an order of direction directing the learned Mahalir Needhimandram, Fast Track Mahila Court, Thiruvannamalai, to conclude the Sessions Case No.55 of 2019 within a period of six months in accordance with law. ORDER

The present Criminal Original Petition is filed by the accused to expedite the trial in Sessions Case No.55 of 2019 pending on the file of the Mahalir Needhimandram, Fast Track Mahila Court, Thiruvannamalai.

2. From the records, this Court found that the complaint of the year 2009, being investigated and final report filed immediately, however, was taken on file by the Sessions Court on committal only on 16.09.2019 from the Magistrate Court, the case is now pending before the Mahila Court, Thiruvannamalai, specially constituted to try cases of offence against women.

3. The petitioner/accused has not cross examined P.W.1 to P.W.4 when they were present and examined in chief. Thereafter, the petitioner/accused has filed a petition to recall those witnesses and the same was allowed. He is still to cross examine P.W.2, P.W.3 and P.W.4. The status report from the Presiding Officer dated 23.05.2024 reveals the reasons for delay in completing the trial.

4. The cause for the delay is attributed to the conduct of the petitioner/accused and the prosecution. The Presiding Officer has addressed a letter to the Superintendent of Police, Thiruvannamalai, on 23.05.2024, directing him to produce the witnesses for examination.

5. Considering the above facts, this Criminal Original Petition is disposed of directing the Investigating Officer to marshal the witnesses and cooperate for completion of trial within a period of two (2) months from the date of receipt of a copy of this order. The petitioner shall not delay the cross examination of the witnesses and he is expected to cross examine the witnesses on the day the witnesses are present, without seeking any adjournment.
