ORDER : The Court Made the following order :- The petitioner, who was arrested on 15.06.2017 for the offences punishable under Sections 341, 294(b), 427, 336, 392, 397 and 506(ii) of IPC in Cr.No.1556 of 2017 on the file of the respondent police, seeks bail.
2. It is the case of the prosecution that the petitioner had robbed the defacto complainant of Rs.1000/- at knife point and had caused damage to a shop. It is seen that this petitioner was involved in Cr.No.1554 of 2017 for an offence under Section 302 of IPC and he was detained under Act 14.
3.The learned counsel for the petitioner submitted that the detention order has been set aside by this Court. This Court has refused bail to the petitioner in Cr.No.1554 of 2017 since committal proceedings are yet to be completed.
4.However, taking into consideration the nature of allegations and the present circumstances, this Court is inclined to grant bail to the petitioner.
5. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties, out of which one shall be a blood related surety, each for a like sum to the satisfaction of the learned XVIII Metropolitan Magistrate, Saidapet, Chennai and on further condition that:
[a] the sureties shall affix their photographs and Left Thumb
Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity. [b] the petitioner shall report before the respondent police as and when required for interrogation.
[c] the petitioner shall not abscond either during investigation or trial.
[d] the petitioner shall not tamper with evidence or witness either during investigation or trial.
[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [f] If the accused thereafter absconds, a fresh FIR can be registered under Section 229A IPC.
