O R D E R

The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence under Sections 506(i) and 506 of IPC in Crime No.93 of 2021, on the file of the respondent, seek anticipatory bail.

2. The case of the prosecution is that on 03.05.2021, the defacto complainant lodged a complaint before the respondent police stating that she is residing in Chinnamangodu Village with her family. The petitioners/A1-A6 were spreading rumour in their village that her elder daughter, who is aged about 15 years, got married with one Panchatcharam, who is living in the same village prior to one week. Further the petitioners threatened the defacto complainant's daughter if she refuse to get marry to one Panchatcharam, they will impose a cost of Rs.1,00,000/- as fine. https://hcservices.ecourts.gov.in/hcservices/

3. The learned counsel appearing for the petitioners submitted that the petitioners innocent and they are nothing to do with the alleged offences. Hence, he prays for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate appearing for the respondent submitted that this court, on an earlier occasion, this Court directed to conduct enquiry and file a report. To that effect, the respondent police has conducted enquiry in presence of the RDO, Ponneri, the Deputy Superintendent of Police, Gummidipoondi, Inspect of Police, Sub-Inspector of Police, Social Welfare Officer, Thiruvallur, President, Vice-President of Chinnamangodu Village and also in the presence of the village elders. Further, the issue was resolved by the villagers to maintain peace. They all agreed to go in peace without any such problem in future.

5. This Court has carefully considered the submissions made on either side and the materials available on record.

6. It is seen from the Status Report that there are prima facie materials against the petitioners and the petitioners will have to necessarily prove their innocence only in the course of trial and the custodial interrogation of the petitioners is necessary.

7. Considering the gravity of the offence made by the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners.
