ORDER
This Criminal Revision case has been filed for setting aside the judgement dated 23.03.2026 in C.A.No.366 of 2022 passed by the learned Additional District and Sessions Judge, No.IV, Coimbatore, confirming the judgement dated 08.11.2024 in S.C.No.41 of 2018 on the file of the learned Additional Sub Judge No.III, Coimbatore, convicting the petitioner for the offence under Section 397 IPC, and sentenced to undergo 7 years rigorous imprisonment and to pay the fine of Rs.1000/-, failing which undergo 2 years simple imprisonment. Along with the Criminal Revision Case, the petitioner has filed the present Criminal Miscellaneous petition, seeking suspension of sentence imposed on him.
2. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl.Side) for respondent and also perused the materials available on record.
3. Considering the submissions made by the learned counsel on either side and taking into account the facts and circumstances of the case and that the petitioner has not surrendered even after the dismissal of the C.A.No.366 of
2024, dated 23.03.2026 on the file of the learned Additional District and Sessions Judge, No.IV, Coimbatore, confirming the conviction and sentence imposed on the petitioner by the trial Court, the question of suspending the sentence does not arise. Hence, this Court is not inclined to entertain the petition. Accordingly, the Criminal Miscellaneous Petition is dismissed. The respondent is directed to secure the petitioner to serve the sentence as imposed by the trial Court.
