Respondents Writ Petition has been filed under Article 226 of the Constitution of Inida, praying for issuance of a writ of mandamus, directing the second respondent to consider the petitioner's representation, dated 02.07.2015, and include the petitioner's name in patta 2014 to 2015 in Survey No.118/3 to the extent of 4.25 acres of property belonging to the petitioner. By consent, the Writ Petition is taken up for disposal.
2. The petitioner would state that he is the absolute owner of the land, admeasuring an extent of 4.25 acres, in Survey No.118/3, situated in Vellaiyur Post, Gangavalli Taluk, Salem District, which was purchased by him through a registered sale deed, dated 13.04.1984, and claims to be in possession and enjoyment of the same from the date of purchase. He, for the purpose of availing loan, applied for patta, but, to his shock and surprise, he found that his name was not included in the said patta. In this regard, he submitted a representation, dated 02.07.2015, to the second respondent and since he has not been favoured with any response, he has come forward to file this Writ Petition.
3. Heard the submissions of the learned counsel for the petitioner and Mr.S.Diwakar, learned Additional Government Pleader, who accepted notice on behalf of the respondents. https://hcservices.ecourts.gov.in/hcservices/
4. This Court, taking into consideration the limited
scope of the prayer, without going into the merits of the claim projected by the petitioner, directs the second respondent to consider and dispose of the petitioner's representation, dated 02.07.2015, in accordance withlaw, after putting on notice the persons concerned and pass orders within a period of six weeks from the date of receipt of a copy of this order and commnicate the decision taken, to the petitioner and also to the persons concerned.
