ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for offences punishable under Sections 296(b), 118(1) and 351(3) of the Bharatiya Nyaya Sanhita (BNS), 2023, in Crime No.106 of 2026 on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that on the day of the alleged occurrence, while the victim was knitting a fishing net, the petitioner, who was in an intoxicated state, intruded upon the victim and used obscene language against him. This led to a verbal altercation, following which the petitioner allegedly stabbed the victim with a knife. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner is in no way connected to this case and has been falsely implicated. He further submits that the petitioner is the sole breadwinner of his family and has not committed any offence as alleged by the prosecution. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police, while reiterating the prosecution's case, strongly opposed the grant of anticipatory bail. He submitted that the alleged occurrence took place on 22.03.2026 due to an issue arising from a temple festival; fueled by this enmity, the petitioner attacked the husband of the de facto complainant with a knife, causing grievous injuries. He further contended that if the petitioner is released on anticipatory bail, there is a high likelihood that he may abscond or continue to commit similar offences, thereby hindering the investigation

Considering the nature and gravity of the offences, particularly the allegation that the petitioner used a deadly weapon to cause grievous injuries to the victim following a dispute at a temple festival, this Court finds the contention for custodial interrogation to complete the investigation cannot be faulted at this stage and to prevent any threat to the witnesses. Consequently, this Court is not inclined to grant anticipatory bail at this stage.
