2024-04-29Honourable Mr Justice P.B. Balaji2 pages

A. No.2415 of 2024 in C.S. No.520 of 2013 P.B.BALAJI, J., This Application has been taken out by the Applicant/8th defendant to condone the delay of 3789 days in filing the written statement of the 8th defendant in C.S. No.520 of 2013.

2. Mr.S.R.Ragunathan, the learned counsel for the respondents 1 to 3, has no serious objection for the delay being condoned and the written statement being received without admitting the facts set out in the affidavit filed in support of the Application. Though the other respondents seeks time to file counter in the above Application, I do not deem fit for the co-defendants to object the filing of the written statement. I have gone through the affidavit filed in support of the above Application and I am satisfied with the reasons assigned in the said Application. Accordingly, this Application is allowed.
