JUDGMENT

The petition has been filed by the wife seeking transfer of HMOP No.4775 of 2014 filed by the respondent/husband before the II Additional Family Court, Chennai for 'restitution of conjugal rights' under Section 9 of the Hindu Marriage Act, 1955 to be transferred to Sub Court, Ranipet, Vellore District where HMOP No.97 of 2014 filed by the petitioner is pending for disposal.

2. Heard both the parties.

3. Considering the fact that the petitioner is living with her parents and she has got no independent income, she cannot travel to Chennai from Ranipet, Vellore, for the sake of convenience, the HMOP No.4775 of 2014 pending before the II Additional Family Court, Chennai is transferred to Sub Court, Ranipet, Vellore to be tried alongwith HMOP No.97 of 2014.

4. In view of the above, the II Additional Judge, Family Court, Chennai is directed to forward the case bundles pertaining to HMOP No.4775 of 2014 to the file of Sub Court, Ranipet, Vellore. https://hcservices.ecourts.gov.in/hcservices/

5. With the above direction, Transfer Civil Miscellaneous Petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
