Criminal Original Petition filed under section 482 of Criminal Procedure Code, praying to direct the respondents to transfer the investigation concerned in Crime No.10 of 2020 on the file of the Inspector of Police, G4-Cheyyur Police Station, Cheyyur Post and Taluk, Chengalpattu District to any other competent authority to conduct a free and fair investigation and to file a final report within a stipulated time. O R D E R
This petition has been filed seeking direction directing the respondents to transfer the investigation concerned in Crime No.10 of 2020 on the file of the Inspector of Police, G4-Cheyyur Police Station, Cheyyur Post and Taluk, Chengalpattu District to any other competent authority to conduct a free and fair
investigation and to file a final report within a stipulated time.
2.The learned counsel appearing for the petitioner would submit that on the complaint lodged by the petitioner, the third respondent has registered a case in Crime No.10 of 2020 for the offences under Sections 147, 323, 324, 448 and 506(ii) IPC as against the accused persons. Even till today the third respondent did not secure the accused and did not conduct any enquiry, FIR's kept in cold storage.
3.The learned Additional Public Prosecutor appearing for the respondents would submit that after registering FIR, the third respondent is proceeding with the investigation. Insofar investigation is still pending.
4.Considering the above submission either side, the third respondent is directed to complete the investigation and file a final report within a period of twelve weeks from the date of receipt of a copy of this order. However, the second respondent is directed to monitor the investigation done by the third respondent and also ensure that the third respondent shall comply the order passed by this Court.
5.With the above direction, this Criminal Original Petition is disposed of.
