PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondent to dispose of appeal dated 19.01.2024 pending on the file of the respondent within stipulated period time frame fixed by this Court and pass orders. ORDER

This petition is filed seeking to issue a Writ of Mandamus directing the respondent to dispose of appeal dated 19.01.2024 pending on the file of the respondent within stipulated period time frame fixed by this Court and pass orders.

2. The facts of the case is that the petitioner is a Secondary Grade 1/4

Assistant in CSI Girls Middle School, Big Kancheepuram and she was issued with a suspension order on 07.04.2022 in Na.Ka.No.301 of 2020 for the reason that the S.S.L.C certificate produced by the petitioner was not genuine. Aggrieved over the same the petitioner filed W.P.No.23168 of 2022 before this Court and the same was dismissed vide order dated 05.09.2022. However liberty was granted to the petitioner to file an appeal before the Appellate Authority and the petitioner also filed an appeal on 19.01.2024 and there was no progress in the said appeal. Hence, this petition.

3. The learned counsel for the petitioner submitted that it would be suffice if this Court issues a direction to the respondent to dispose of the appeal filed by the petitioner on 19.01.2024 and pass orders.

4. The learned Special Government Pleader appearing for the respondent submitted that they will consider the case of the petitioner and take action in the manner known to law.

5. Considering the facts and circumstances of the case and the 2/4

limited relief sought for by the petitioner, this Court directs the respondent to dispose the appeal filed by the petitioner after conducting an enquiry by affording reasonable opportunity of hearing to the petitioner as well as the concerned parties and pass orders within a period of twelve weeks from the date of receipt of a copy of this Order.

6. With the above observations this writ petition stands disposed of. No order as to costs.
