Transfer Civil Miscellaneous Petition filed under Section 24 of the Code of Civil Procedure to withdraw H.M.O.P.No.164 of 2014 pending on the file of the Principal Subordinate Judge, Cuddalore and transfer the same to be heard along with M.O.P.No.39 of 2014 before the learned District Judge at Karaikal.

Though the respondent has entered appearance through counsel, there is no representation for the respondent. The submissions made by Ms.Fanny Rajan, learned counsel appearing for M/s.K.M.Aasim Shehzad, counsel on record for the petitioner are heard. The materials placed for the perusal of this court are also considered.

2. The H.M.O.P.No.164/2014 pending on the file of the Principal Subordinate Judge, Cuddalore is the one filed by the respondent herein, who is the husband of the petitioner herein. The petitioner herself has filed M.O.P.No.39/2014 on the file of the District Judge at Karaikal. She wants transfer of the HMOP filed by her husband, namely the respondent herein, to the file of the District Judge, Karaikal to be tried along with her OP, namely M.O.P.No.39/2014. The reasons assigned by the petitioner are satisfactory.

Accordingly, the transfer civil miscellaneous petition is allowed. H.M.O.P.No.164/2014 pending on the file of the Principal Subordinate Judge, Cuddalore is withdrawn and https://hcservices.ecourts.gov.in/hcservices/

transferred to the file of the District Judge, Karaikal to be tried jointly with M.O.P. No.39 of 2014 filed by the petitioner herein (wife). However, there shall be no order as to cost.
