ORDER

1. Heard.

2. This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure seeking withdrawal of H.M.O.P. No. 702 of 2023 pending on the file of the Family Court at Tirupur and transfer of the same to the file of the Principal Sub Court at Kallakurichi, Kallakurichi District.

3. The marriage between the petitioner and the respondent was solemnized on 31.08.2020 at SR A/C Mahal, Kallakurichi as per Hindu rites and customs. Out of their wedlock, a female child was born to them on 04.03.2023. The respondent/husband filed divorce petition in HMOP No.702 of 2023 before the Family Court, Tiruppur.

4. The petitioner is the wife and she is residing at Kallakurichi. It is stated that she is taking care of a 21⁄2 years old child. It is further submitted that, having regard to the distance factor, it would cause hardship to the petitioner to travel and attend the proceedings at Tiruppur. It is also submitted that the matter is at the stage of "counselling".

5. Though the respondent's name is printed in the cause list, today when the matter is taken up for hearing, there is no representation on behalf of the respondent.

6. Considering the residence of the petitioner, the distance and hardship pleaded, and the responsibility of the petitioner towards the minor child, this Court is satisfied that the transfer sought deserves to be ordered.

7. Accordingly, Tr.C.M.P.No.496 of 2024 is allowed. H.M.O.P.No.702 of of 2023 pending on the file of the Family Court, Tiruppur is withdrawn and transferred to the file of the Principal Sub Court, Kallakurichi. The Family Court, Tiruppur shall transmit the entire records to the Principal Sub Court, Kallakurichi, within three weeks from the date of receipt of a copy of this order and the Principal Sub Court, Kallakurichi shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order. Consequently, connected C.M.P.No.10190 of 2024 is closed. There shall be no order as to costs.
