ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 15.04.2022 for the offences punishable under Sections 324, 307 of IPC altered into 302 of IPC in crime No.399 of 2022 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that before tasmac shop, the petitioner along with another accused attacked the deceased with beer bottle due to wordy quarrel between them, due to which the deceased sustained grievous injuries and died. Hence, the case.
3. The learned counsel for the petitioner would submit that the petitioner was arrested and remanded to judicial custody on 15.04.2022. Due to wordy quarrel between them, there was a push and pull, in which the deceased injured and died. https://hcservices.ecourts.gov.in/hcservices/
4. The learned Additional Public Prosecutor would submit that the petitioner is a habitual offender and so far, he has involved in six previous cases, that too under NDPS and other very serious offences. He would further submit that the investigation is still pending since the petitioner was arrested only on 15.04.2022.
5. It is seen that the petitioner is arrayed as A2 and he is having six previous cases similar in nature. That apart, the petitioner and another accused attacked the deceased with beer bottle in tasmac shop and due to which, he sustained grievous injuries and died. Therefore, this Court is not inclined to grant bail to the petitioner.
