The suit for infringement of copyright is filed against the three defendants.

2.The 1st defendant has filed his written statement on 05.03.2021. The 3rd defendant herein has filed an adoption memo stating that she wants to adopt the written statement filed by the 2nd defendant on 17.12.2019. However, due to the caption given to the written statement of the 2nd defendant that it is a 'common written statement filed on behalf of the 2nd and 3rd defendants' and later corrected as adoption memo of the 3rd defendant it could not be taken on file. Now on Abundant caution, the 3rd defendant has taken out the application to condone the delay of 389 days in filing the adoption memo.

3. This Court, on verifying the record and on hearing Mr.Srinath Sridevan, learned counsel for the applicant and the learned counsel for the plaintiff, accept the adoption memo dated 04.01.2021 filed by the 3rd defendant indicating that he adopts the written statement filed by the 2nd defendant dated 17.12.2019.

4. In view of this Court, the condone delay application is unwarranted in the fact of this case. Hence, the application is disposed of, accepting the adoption memo filed by the 3rd defendant. 09.09.2021 rpl/ata 2/3
