This writ petition has been filed challenging the impugned proceedings of the fifth respondent dated 31.01.2025 and for a consequential direction to the fifth respondent to issue patta in the name of the petitioner with respect to the subject property.
2. Heard Mr.V.Karthikeyan, learned counsel for petitioner and Mr.P.Sathish, learned Additional Government Pleader appearing for respondents.
3. The petitioner has issued the online rejection order dated 2/4
31.01.2025 without assigning any reasons. On that ground alone, the said order is liable to be interfered with by this Court.
4. The fifth respondent has stated that there is a discrepancy between the boundaries found in the sale deed and the boundaries as on the ground. If such a clarification is required, the fifth respondent should have called the petitioner for enquiry and got the clarification. Instead, the fifth respondent has mechanically rejected the application. In view of the above discussion, the impugned refusal check slip dated 31.01.2025 is hereby quashed. The matter is remanded back to the file of fifth respondent and the fifth respondent shall conduct enquiry and pass a reasoned order within a period of four (4) weeks from the date of receipt of a copy of this order.
