The petitioner, who was arrested and remanded to judicial custody on 10.04.2023 for the alleged offences under Sections 294(B), 323, 324 and 307 of IPC in crime No.241 of 2023 on the file of the respondent police, seeks bail.

2. It is the case of the prosecution that on the influence of the defacto complainant, the petitioner joined as Cook in China in the year 2019. Due to covid pandemic, he returned to his native. When the petitioner asked about the pending salary for two months, there was wordy quarrel on the occurrence day. At that time, the petitioner attacked him with hammer on his head, thereby he fell down.

3.The learned counsel appearing for the petitioner would submit that the petitiner is an innocent person and he has been falsely implicated in this case. Hence, he seeks for grant of bail to the petitioner. 4.The learned counsel for the intervenor submitted that the petitioner attacked the victim with deadly weapons, thereby he sustained grievous

injuries and he was admitted into hospital. He further submitted that the injured is still in hospital. As such, he vehemently opposed to grant bail to the petitioner.

5.The Additional Public Prosecutor would submit that the injured is still in hospital because of the injuries caused by the petitioner. Therefore, he vehemently opposed to grant bail to the petitioner.

6. Considering the submissions of the learned counsel for the intervenor and the learned Additional Public Prosecutor that the injured is taking treatment in the hospital even till today because of the grievous injuries caused by the petitioner with deadly weapon, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this criminal original petition is dismissed. 05.05.2023 lok (2/2)
