ORDER : The Court Made the following order :- The petitioners/A1 & A2 apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 4(1)(aaa) r/w 4(1-A) of TNP Act, in Crime No.232 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that on 25.05.2022 based on the secret information, the respondent Police found the petitioners herein with illegal possession of 110 litres of I.D arrack. However, the petitioners escaped from the scene of occurrence. Hence, the complaint.

3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and no way connected with the alleged offence. He further submitted that the petitioners have been falsely implicated in this case. Hence he prays to grant anticipatory bail to the petitioners.

4. The learned Additional Public Prosecutor submits that the investigation is not yet completed and if the petitioners are granted anticipatory bail, there is a possibility that they will tamper the witnesses and hamper the investigation. there are six previous cases pending against the A1 and twenty seven previous cases pending against the A2. Hence he vehemently opposed to grant anticipatory bail to the petitioners.

5. Taking into consideration the allegations and also the bad antecedent of the petitioners and the fact that the case is in the initial stage of the investigation and that the custodial interrogation of the petitioner is essential, this Court is not inclined to grant anticipatory bail to the petitioners.
