PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the 1st respondent to consider the request of the petitioner to withdraw the security guards of two armed PSOs provided by the 3rd respondent and provide the same through the 2nd respondent.

ORDER
This Criminal Original Petition has been filed by the petitioner seeking direction to withdraw the two armed Personal Security Officers provided by the 3rd respondent and provide the same through the 2nd respondent.
2.The learned counsel for the petitioner submitted that the petitioner was earlier provided by the two armed Personal Security Officers as per the order of this Court, dated 19.08.2019 in Crl.O.P.No.17790 of 2019 considering the threatening calls and there was a demand for a ransom and finding the threat perception for the life and safety being real. At the time of passing the order, the petitioner was having office in Thiruvarur and he was frequently visiting the office. Hence, the 3rd respondent was directed to provide two armed Personal Security Officers to ensure that the life and limb of the petitioner is not subjected to any threat and further, the petitioner to pay necessary cost as undertaken by him in the representation.
3.The learned counsel further submitted that now, the petitioner had sent a complaint on 23.06.2021 to the 4th respondent Police stating that still he is receiving life threat calls and demand of ransom and also stated that on 24.06.2021, similar calls received. The petitioner due to prevailing COVID19 pandemic situation, mostly carrying on his work from his home situated at Kumbakonam, which is within the jurisdiction of the 2nd respondent. Though the 1st respondent is common DIG Range officer for both Thanjavur District as well Thiruvarur District, still the Personal Security Officer from Thiruvarur District are providing security for him. The petitioner is making necessary payments regularly without any dues.
Since the threat perception is continuing, the only request of the petitioner is that the two armed Personal Security Officers from Thiruvarur District may be withdrawn and the same may be provided through the 2nd respondent. The petitioner undertakes to continue to comply with the other conditions. Hence, he prayed for appropriate direction. 4.The learned Government Advocate (Crl. Side) appearing on behalf of the respondents submitted that this Court granted two armed Personal Security Officers, by order, dated 19.08.2019 in Crl.O.P.No.17790 of 2021. Due to pandemic COVID-19 situation, the petitioner is now working from Kumbakonam. On the complaint given by the petitioner, the 4th respondent assigned C.S.R.No.405 of 2021 on 25.06.2021. From the complaint, it is seen that the petitioner's threat perception still exists.
The petitioner is working from home situated at No.530, North Agraharam, Thippirajapuram (Post), Kumbakonam, Thanjavur District for the present.
5.On considering the submissions, it is an admitted fact that the petitioner is now working from Kumbakonam and the threat perception is still it continues. In view of the same, it would be appropriate that the petitioner to be provided with the two armed Personal Security Officers through the 2nd respondent, the District Police from where the petitioner functions.
6.Hence, the petitioner is directed to submit his representation dated 23.06.2021 along with the copy of this order to the 1st respondent who shall act upon the same and provide Private Security Officers through the 2nd respondent subject to payment of cost, consequently private guards now provided through the 3rd respondent to be withdrawn. 7.With the above directions, this Criminal Original Petition is disposed of.
