Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, forbearing the 1st respondent herein from further demolishing the petitioner's building in the land owned by the petitioner admeasuring 1800 Squre feet of the land comprised in S.No.61/2 Ward, H-Block No.14, T.S.No.48/2, Mogappair Village, Ambattur Taluk, Tiruvallur District.

ORDER

[Order of the Court was made by M.SATHYANARAYANAN, J.] After some arguments, the learned counsel for the petitioner, on instructions, seeks the permission of this Court to withdraw this writ petition with a liberty to file a fresh writ petition and also made an endorsement to that effect and it is relevant to extract the same :

" The Petitioner is permitted to withdraw the writ petition and liberty may be accorded to file a fresh writ petition on different cause of action"

Heard the submissions of the learned counsel for the petitioner and Mr.A.Nagarajan, learned standing counsel appearing for 1st respondent and Mrs.M.E.Rani Selvam, Additional Government Pleader appearing for 2nd respondent. In view of the submission and endorsement made by the learned counsel appearing for the petitioner, this writ petition is dismissed as withdrawn.

Liberty sought for by the petitioner, is granted. No costs. Consequently, the connected miscellaneous petition is also closed.
