ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 8 (c) r/w 20(b) (ii) (C) of NDPS Act in Crime No. 490 of 2022, seek anticipatory bail.

2. The case of the prosecution is that the petitioners were in illegal possession of 44 Kgs of Ganja in Polythin Bag. Hence, the complaint.

3. The learned counsel appearing for the petitioners would submit that the petitioners have been falsely implicated in this case and they are ready and willing to abide by any stringent conditions that may be imposed on them.

4. The learned Additional Public Prosecutor would submit that the petitioners are having illegal possession of 44 Kgs of Ganja. The petitioners are arrayed as A2 and A3 and they are husband and wife. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.

5. Considering the nature of offence committed by the petitioners, the custodial interrogation of the petitioners is very much required in this case and therefore, this Court is not inclined to grant anticipatory bail to the petitioners.
