Respondents PRAYER : Writ Petition has been filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to direct the second respondent to consider and pass orders on the appeal petition dated 04.01.2017 for a re-fixation of seniority in the cadre of Assistant as the petitioner was full qualified and eligible on the crucial date as on 01.03.1995 and consequently grant notional promotion from the date on which his junior one Elangovan came to be promoted as Assistant and confer all consequential benefits.

O R D E R

Aggrieved by the placement of seniority in the cadre of Assistant, the petitioner has filed an appeal on 04.01.2017 before The District Collector, Villupuram District, Villupuram / the second respondent herein. The said appeal has not been disposed of so far. Therefore, the petitioner has come to this Court on the ground that he has been made to lose his seniority of further promotion and it is also his case that his junior one Elangovan was promoted and in the result, he has been put to harassment.

2. Heard Mr.S.Kamadevan, learned counsel appearing for the petitioner and Mr. V.Jayaprakash Narayanan, learned Special Government Pleader appearing for the respondents, who sought four weeks time to dispose of the appeal, on merits and in accordance with law.

3. Considering the limit relief sought for by the petitioner, this Court directs the second respondent to consider the appeal filed by the petitioner dated 04.01.2017 and pass appropriate orders, on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

4. With this direction, the Writ Petition is disposed of accordingly. No costs.
