ORDER

The present Writ Petition has been filed challenging the order passed by the Additional Chief Secretary to Government in and by which, the claim of the petitioner seeking permission for conducting B.Sc Course in the petitioner college was rejected.

2. Ms.M.Sneha, learned Special Counsel takes notice on behalf of the respondents.

3. The petitioner herein is an Educational Trust formed with an object to impart higher education to the poor students in and around the rural areas which has established multiple institutions. It is the case of the petitioner that the petitioner had submitted a representation to the respondents seeking permission to commence B.Sc.Nursing course with an intake of 100 students for the academic year 2025-26. Pursuant to which, after conducting an inspection through a duly constituted committee as to the verification of availability of infrastructural and other facilities for conducting B.Sc, Nursing Course upon

receipt of necessary documents from the petitioner, the present impugned order had come to be passed by rejecting the petitioner's claim on the ground that there is lack of adequate clinical facilities in the petitioner college. Aggrieved by which, the present Writ Petition has been filed.

Though a larger relief has been sought for in this Writ Petition, at the time of arguments, learned counsel appearing for the petitioner restricted the prayer and submitted that as against the order impugned, the petitioner may be permitted to file a review application before the 1st respondent by explaining the rule position with regard to the tie up arrangement with the Government Hospital for the purpose of clinical materials and accordingly, he prayed this Court to pass appropriate orders.

5. Acceding to the aforesaid submissions, the learned special counsel appearing for the respondents submitted that upon receipt of the petitioner's review application, the same would be considered in accordance with law.

6. In view of the limited relief sought for by the petitioner, this Court without interfering with the impugned order, permits the petitioner to file a review application before the 1st respondent as against the order impugned in this Writ Petition within a period of two weeks from the date of receipt of a copy of this order and upon receipt of the review application, the 1st respondent is directed to consider and pass appropriate orders on the same in accordance with law within a period of six weeks thereafter.
