ORDER

This Criminal Revision Case has been filed by the petitioner to set aside the order dated 14.03.2023 passed in C.M.P.No.6132 of 2023 in S.T.C.No.296 of 2019 on the file of the Judicial Magistrate No.1, Udumalpet.

2. Today, when the matter is taken up for hearing, the learned counsel for the petitioner submitted that the respondent filed a complaint against the petitioner under Section 138 of the Negotiable Instruments Act in S.T.C.No.296 of 2019 on the file of the Judicial Magistrate No.1, Udumalpet and pending case, the petitioner filed a petition in C.M.P.No.6132 of 2023 invoking Section 45 of the Indian Evidence Act to send the disputed cheque for export opinion, but the same was dismissed by order date 14.03.2023, against which, the present revision was filed before this Court. He further submitted that pending revision, the petitioner filed another petition before the Magistrate and the same was allowed and now the case is pending for examination of witnesses. Therefore, nothing survives in this petition for further adjudication. 2/4

3. Recording the submissions of the learned counsel for the petitioner, this Criminal Revision Case is dismissed. Consequently, the connected Miscellaneous Petition is closed.
