ORDER

This criminal original petition has been filed seeking a direction to the respondents to register the complaint of the petitioner dated 02.04.2016.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. On a reading of the complaint dated 02.04.2016 given by the petitioner, it is seen that on 03.01.2016, this petitioner was going in his mother's bike bearing registration number TN 11 https://hcservices.ecourts.gov.in/hcservices/

M 8995 and when he was nearing Injimedu Village at about 9.30 in the night, he had fallen from his bike because his vision was blurred due to the head lights of a lorry, which was coming in the opposite direction, on account of which, the petitioner sustained certain injuries. According to the petitioner, since it was during the course of his employment, he will have workmen compensation. Therefore, the petitioner has given a complaint.

4. It is the contention of the learned counsel for the petitioner that the petitioner sent a complaint dated 02.04.2016 to the respondent police and he has come up with this petition for a direction to the respondent police to register an FIR.

5. In the considered opinion of this Court, the complaint dated 02.04.2016 does not disclose any commission of cognizable offence and therefore, no positive direction can be given to the respondent police to register an FIR. However, it is open to the petitioner to approach the concerned authorities and seek workmen compensation, if he otherwise entitled to in accordance with law.
