ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 30.04.2022 for the offences punishable under Sections 3(1), 4(2) (b), 5(1)(a) of Immoral Traffic (Prevention) Act and 366A of IPC @ 3(1), 4(2)(b), 5(1)(a) of Immoral Traffic (Prevention) Act and 366A of IPC and 3(a), 17 of POCSO Act in crime No.2 of 2020 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the defacto complainant was working in a beauty parlour. A2 brought her to Ambur and handed over to A1 for prostitution. Subsequently, she was forced for prostitution and on 06.01.2020, the petitioner took the defacto complainant to many places and compelled for prostitution. Again she was handed over to A1 and A1 used her for prostitution to earn money. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner was arrested and remanded to judicial custody on 30.04.2022. Therefore, he prays for grant of bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that there are totally four accused, in which the petitioner is arrayed as A3. He would further submit that the entire allegation is against this petitioner only. Hence, he vehemently opposed to grant bail to the petitioner.

5. It is seen that there are totally four accused, in which the petitioner is arrayed as A3 and he is the main person to engage the victim for prostitution. That apart, on perusal of the statement recorded from the victim girl under Section 164 of Cr.P.C, revealed that the petitioner has committed very serious offence as against the victim and in fact, the accused persons administered some drug and thereafter committed sexual assault on the victim girl and also compelled and involved her in prostitution. Therefore, this Court is not inclined to grant bail to the petitioner.
