The petitioner, who is a legatee under the Will dated 11.07.1989 seeks issuance of letters of administration in respect of the said Will with the copy of the same annexed.

2. According to the petitioner, the testator who is his grand mother's sister and her husband had died issue less on 17.06.1993 & 10.02.1980 respectively. According to the petitioner, there are no legal representatives available for either the testatrix or the husband of the testatrix, who would otherwise inherit the property. The petitioner has examined himself as P.W.1. He has produced the death certificate of the testatrix as Ex.P1 and the original Will as Ex.P2. The legal heirship certificate of A.Annammal has also been filed as Ex.P3. Publication has been effected as required under law and no objections have been received. The petitioner has examined one M.Mani as P.W.2, he has identified the signature of one of the attesting witnesses.

3. Considering the evidence available and the fact that the Will is the registered instrument, I find that the petitioner has established the execution of the Will by the testatrix. In fine, this original petition is allowed granting letters of administration with the copy of the Will annexed in favour of the petitioner.
