( Criminal Jurisdiction ) Monday, the Sixth day of June Two Thousand Twenty Two PRESENT The Hon`ble Mr Justice D.BHARATHA CHAKRAVARTHY CRIMINAL MISCELLANEOUS PETITION No.7000 of 2022 IN CRL RC.667/2022 K.RAJA RAO [ PETITIONER ] Vs 1 N.P.LAKSHMI [ RESPONDENTS ] 2 TEJASHREE KOLLURI Petition praying that in the circumstances stated therein the High Court will be pleased to Suspend the Sentence imposed on the petitioner in MP.1115/2019 in MC.238/2016 dated 23.05.2022 (viz., the respondent to undergo One Month S.I u/s 125(3) Cr.P.C for his default payment for the period from 26.11.2018 to 26.10.2019 a sum of Rs.7,70,000/-(Rupees Seven Lakhs Seventy Thousand Only) towards arrears of maintenance at the rate of Rs.70,000/-(Rupees Seventy Thousand only) per month enlarge the petitioner on bail pending disposal of the above Crl.RC.No.667/2022.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.S.SASIKUMARR, Advocate for the petitioner the court made the following order:- The learned Counsel for the petitioner would submit on 23.05.2022, the sentence of one month imprisonment was imposed in M.P.No.1115 of 2019 in M.C.No.238 of 2016. The petitioner was taken into custody and now he is in prison for almost 15 days. Regarding the arrears amount payable, the learned Counsel would submit that a condition may be imposed for deposit of Rs.5,00,000/- within a period of one month from the date of release of the petitioner.

2. Now, considering the facts and circumstances of the case, there shall be an order of suspension of sentence imposed on the petitioner on the following conditions:- (a) the petitioner is ordered to be released on bail, on his executing a bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties each for a like sum to the https://hcservices.ecourts.gov.in/hcservices/

satisfaction of the learned VII Additional Principal Judge, Family Court, Chennai;

(b) the petitioner and the sureties shall affix their photographs and left thump impressions in the surety bonds and the learned Judge may obtain a copy of their Aadhar Cards or Bank Pass books to ensure their identities;

(c) the petitioner shall pay a sum of Rs.2,50,000/- (Rupees two lakhs fifty thousand only) in the above Revision Case within a period of four weeks, failing which, the order of suspension of sentence shall stand cancelled automatically;
