ORDER

This criminal original petition has been filed seeking a direction to the respondent police to register an FIR on the basis of the complaint dated 29.06.2016 given by the petitioner.

2. When the matter is taken up for hearing, the learned Additional Public Prosecutor, on instructions from the respondent police, submitted that the police have not received the complaint dated 29.06.2016. He further submitted that on 29.06.2016, the control room (100) was called by both the parties and Inspector of Police went to the place and enquired the parties and neighbours and it was found that the dispute was essentially civil in nature.

3. The learned counsel for the petitioner submitted that the petitioner sustained injuries on 29.06.2016 at the incident.

4. The learned Additional Public Prosecutor further submitted that there are several complaints and cross complaints between the petitioner and the opposite party and https://hcservices.ecourts.gov.in/hcservices/

in fact, the cases are pending from 2011 onwards.

5. Under such circumstances, the petitioner is directed to go in person and lodge a fresh complaint to the respondent police, on the same content. On receipt of such complaint, the same shall be enquired into and action be taken thereon in accordance with law, if it discloses the commission of a cognizable offence or drop action otherwise.

In view of the above, the criminal original petition is closed.
