Criminal Original Petition filed under section 482 of Criminal Procedure Code, praying to direct the respondents to initiate action on the complaint/representation of the petitioner dated 12.08.2010 and conduct a detailed enquiry in accordance with law and consequently give adequate police protection to the petitioner and other newly elected officer bearers so as to perform their legitimate duties attached with their office to protect its one lakh members. O R D E R
This petition has been filed seeking a direction directing the the respondents to initiate action on the complaint/representation of the petitioner dated 12.08.2010 and conduct a detailed enquiry in accordance with law and consequently give adequate police protection to the petitioner and other newly elected officer bearers so as to perform their legitimate duties attached with their office to protect its one lakh members.
2.The learned counsel for the petitioner would submit that there is a dispute in respect of their election between various association and third respondent. Hence, he sought for police protection.
3.The learned Additional Public Prosecutor would submit that the petitioner as well as the third respondent have lodged complaints respectively to the second respondent and on receipt of the same C.R.S.Nos.312 & 313 of 2020 were assigned and both the complaints are pending for enquiry.
4.Considering the above submissions, the second respondent is directed to enquire the complaints lodged by the petitioner and third respondent herein, after issuing notice to parties concerned and on completion of enquiry, the third respondent shall pass appropriate orders on merits and in accordance with law, within a period of four weeks, from the date of receipt of a copy of this order.
4.With the above direction, this Criminal Original Petition is disposed of.
