Originally, the respondent-husband has filed H.M.O.P.No.51 of 2012 under section 9 of the Hindu Marriage Act before the Subordinate Court, Ponneri and Tr.C.M.P.No.703 of 2012 was filed by the wife before this Court and while the same was pending, the husband had filed H.M.O.P.No.11 of 2015 on the file of the Sub Court, Ponneri for divorce under Section 13(1) (ia) and (ib) of the Hindu Marriage Act, against which, Tr.C.M.P.No.179 of 2015 is filed by the wife. It is now stated that H.M.O.P.No.11 of 2015 pending on the file of the Sub Court, Ponneri was decreed ex-parte on 30.10.2015. In view of the same, Tr.C.M.P.No.179 of 2015 is dismissed as infructuous.
