COMMON PRAYER : Criminal Original Petitions filed under Section 482 of BNSS, 2023, to enlarge the petitioners on bail, in the event of their arrest by the Respondent Police, pending investigation of the case in Crime No.10 of 2026 on

MR.K.SUDHAKAR (in both Crl.OPs.) COMMON ORDER The petitioners apprehend arrest at the hands of the respondent police for the offences punishable under Sections 316(2), 318(2), 296(b) and 351(2) of BNS, 2023 in Crime No.10 of 2026, on the file of the respondent Police, seek anticipatory bail.

The allegation against the petitioner namely A1/Ramkumar in Crl.OP.No.8586 of 2026, is that he developed a purpetable relationship with the defacto complainant and received a sum of Rs.10 lakhs from her, and suppressed the fact of his marriage with the second petitioner, who is the first petitioner in Crl.OP.No.8587 of 2026. Hence, the case.
3. The learned counsel for the petitioners submitted that the second
petitioner in Crl.OP.No.8587 of 2026 is the father-in-law of the fist petitioner. He further submitted that except A1, there are no specific overt acts against the petitioners in Crl.OP.No.8587 of 2026 and they had no knowledge about the relationship between A1 and the defacto complainant. Hence, he seeks anticipatory bail to the petitioners.
4. The learned counsel for the intervener submitted that all the accused, with the same modus operandi, joined together to cheat and extract money from the vulnerable victim girl. Hence, he strongly opposed the anticipatory bail to the petitioners.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that though the petitioners in Crl.OP.No.8587 of 2026 were not arrayed as accused in the earlier FIR registered in the year 2021. In the present case, specific overt acts against these petitioners and by referring to the materials collected, including the contacts, he submitted that these petitioners are also actively involved in the offence. Hence, he opposed to grant anticipatory bail to the petitioners.
6. I have given anxious consideration to the submissions made by the learned counsel on either side.

Taking into consideration, the nature of the allegations, the materials indicating the involvement of the petitioners and the past conduct of the first petitioner, this Court is of the view that if the petitioners are enlarged on bail, it would make it difficult for the prosecution to proceed with the investigation and may also jeopardize the case of the prosecution. Hence, this Court is not inclined to enlarge the petitioners on anticipatory bail.
8. Accordingly these Criminal Original Petitions are dismissed. Consequently, connected Miscellaneous Petitions are closed. 17-04-2026 DRL To 1.The Inspector of Police, All Women Police Station-East, Coimbatore City.
