ORDER
The present criminal original petition has been filed seeking a direction to the learned XI Metropolitan Magistrate, Saidapet, Chennai, to expedite the trial in C.C.No.14074 of 2009 and complete the same within one month.
2. It is the case of the petitioner that he had lodged a complaint with the first respondent police as against the respondents 2 to 7 and the same was registered in Crime No.235 of 2008 for the alleged offence punishable under Sections 406 and 420 I.P.C. In the said case, after completion of investigation, charge sheet was filed and the same was taken on file as C.C.No.14074 of 2009 by the learned XI Metropolitan Magistrate, Saidapet, Chennai. Now, the petitioner has come up with the present petition seeking a direction to the learned XI Metropolitan Magistrate at Saidapet, Chennai to expedite the trial in C.C.No.14074 of 2009 and complete the same within one month.
3. Learned counsel appearing for the petitioner submitted that the petitioner is a senior citizen and though the case is of the year 2008, the same is pending for the past seven years.
4. Learned Additional Public Prosecutor submitted that already four witnesses were examined on the side of the prosecution and the matter stands posted to 21.1.2016 for examination of further witnesses.
5. In view of the limited order going to be passed hereunder, this Court is of the opinion that there is no need to issue notice to the respondents 2 to 7.
6. Considering the facts and circumstances of the case and considering the fact that the said case is pending for the past seven years, this Court directs the learned XI Metropolitan Magistrate, Saidapet, Chennai to expedite the trial of the case in C.C.No.14074 of 2008 pending on his file and dispose of the same as expeditiously as possible, preferably, within a period of six months from the date of receipt of a copy of this order. The Criminal Original Petition is disposed of accordingly.
