Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking a writ of certiorarified mandamus to call for the records relating to the fourth respondent vide proceedings No.Roc.57/2017/A3, dated 23.01.2017, and to quash the same and consequently set aside the retention order issued by the third respondent vide proceedings Roc.No.16722/2009/A1, dated 31.12.2014 and permit the petitioner to retire from service with all attendant benefits.

Challenging the retention order dated 23.01.2017 passed by the fourth respondent, the petitioner has filed this writ petition with a further direction to the third respondent to permit him to retire from the service with all attendant benefits.

2. When the matter is taken up, learned counsel for the petitioner submitted that the issue involved in this writ petition is squarely covered by the order passed by me in W.P.No.9235 of 2017, dated 05.06.2017. Learned Additional Government Pleader for the respondents also, by agreeing with the said submission, pleaded to pass the order in terms of the above said writ petition.
3. In the light of the above, the writ petition is disposed of in terms of the order passed by me in W.P.No.9235 of 2017, dated 05.06.2017. Since the petitioner had reached the age of superannuation on 31.12.2014, the respondents are directed to forward the proposal relating to his retiral benefits to the authorities concerned within a period of four weeks from the date of receipt of a copy of this order. No Costs.
