Both the parties are present. Mr.S.Arunkumar, learned counsel for the appellant and Mr.V.A.Muthu, learned counsel for the respondents are present. After mutual discussion, negotiation, mediation and conciliation between both the parties, they arrived at a compromise to settle the matter as follows:- TERMS OF SETTLEMENT
1. This Civil Miscellaneous Appeal has been filed by the Insurance company as against the award passed by the Deputy Commissioner of Labour - II, Workman Compensation Chennai in W.C.No.241 of 1999 dated 01.10.2002, for a sum of Rs.1,84,170/- .
2. The said award amount has already been deposited. After negotiation and discussion and deliberations, the parties have come to a conclusion and the appellant
Insurance company is agreed to withdraw this Civil Miscellaneous Appeal.
3. In view of the above, the claimants are permitted to withdraw the amount lying in deposit before the Deputy Commissioner of Labour - II, Workman Compensation, Chennai.
4. Apportionment shall be as per the award passed by the Deputy Commissioner of Labour - II, Workman Compensation, Chennai.
5.Recoding the said settlement made between the parties, this Civil Miscellaneous Appeal is disposed of as settled out of Court. 6.Award is passed accordingly.

The Court fee paid shall be refunded to the parties in the manner provided under the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
