COMMON PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorarified Mandamus, calling for the records in Memo No.016129/391/Admn.II / A.1/F.RT/18-2, dated 08.03.2018 on the file of the second respondent herein and the petitioner name was mentioned in Serial No.1 & 2 respectively and quash the same and consequently direct the second respondent to relive the petitioner as per transfer order issued by the first respondent dated 26.08.2017.

C O M M O N O R D E R By consent of both sides, the writ petitions are taken up for final disposal at the stage of admission itself.

2. W.P.No.12448 of 2018 is filed by Mr.T.Sridhran, who is senior to the petitioner who has filed W.P.No.12449 of 2018. They both aggrieved by the cancellation of the transfer order dated 08.03.2018, passed by the Superintending Engineer, Generation Circle, Kundah.

3. Heard the learned counsel for the petitioner as well as learned counsel who took notice on behalf of the respondents. 4.According to the petitioners, because of the cancellation of the transfer order, they will be reverted back to work under the second respondent itself.

5. The learned counsel who took notice on behalf of the respondents stated that if there is a vacancy once again necessary transfer order would be issued.

6. If such transfer is issued, the writ petitioner in W.P.No.12448 of 2018 and Writ petitioner in W.P.No.12449 of 2018 are to be given priority and their cases are to be considered in a positive manner by the respondents. At any rate, the respondents should take decision either to transfer or not to transfer the petitioners by 31.05.2018. If no decision is taken by 31.05.2018, both the writ petitioners are at liberty to approach this Court once again.

6. With such observation, the writ petitions stand disposed of. Consequently, the connected Miscellaneous Petition are closed. However, there shall be no order as to costs. Sd/- Assistant Registrar/V.O.(Rules) //True Copy// Sub Assistant Registrar ah/arr
