PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Mandamus directing the 3rd respondent herein to consider the representation of the petitioner dated 11.03.2024 with the recommended proposal made by the 4th respondent in its Na Ka No.A1/1141/2023 dated 31.03.2023 to grant computer patta in favour of the petitioner and upload the same in the online website in respect of the property in survey No.601 with T.S No.3, Survey No.601 part with T.S No.16 and 15, Survey No.601/4 with T. S No.13 and 14, Survey No.600 part with T. S No.11/2 and 12/2 Survey No. 603/3 with T.S.No.45, Survey No.604 part with T. S No.49/1, Survey No.594 part with T.S.No.48/2 and Survey No.612 part with T. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed praying for a writ of mandamus to direct third respondent herein to consider the representation of the petitioner dated 11.03.2024 with the recommended proposal made by the 4th respondent in its Na Ka No.A1/1141/2023 dated 31.03.2023 to grant computer patta in favour of the petitioner and upload the same in the online website in respect of the property 2/7
comprised in survey No.601 with T.S No.3, Survey No.601 part with T.S No.16 and 15, Survey No.601/4 with T.S No.13 and 14 Survey No.600 part with T.S No.11/2 and 12/2 Survey No.603/3 with T.S.No.45, Survey No.604 part with T. S No.49/1, Survey No.594 part with T.S.No.48/2 and Survey No.612 part with T.S No.50/2 respectively situated in Madhavaram Village and Taluk, Chennai District.

It is submitted by the learned counsel for the petitioner that the subject property was acquired by the first respondent vide G.O.Ms.438, PW (R1) Department, dated 31.08.2000 and the same was published in the Tamil Nadu Government Gazette on 20.09.2000. The said Government Order was challenged before the Hon'ble Supreme Court by the original owners/vendors of the petitioner's mother. The Hon'ble Supreme Court quashed the said Government Order by the judgment reported in (2015) 3 SCC 353. In the meanwhile, the petitioner's mother purchased the subject property and settled in the name of the petitioner by way of a settlement deed on 19.10.2013. Thereafter, the petitioner submitted a representation dated 11.03.2024 seeking issuance of online patta in respect of the subject property before the third respondent. However, the same was not considered so far. Aggrieved by the same, the petitioner has come before this 3/7
Court.
4. It is submitted by the learned counsel for the petitioner that similarly placed individuals have been issued with online patta. However, the petitioner has not been issued with patta.

At the outset, the learned Special Government Pleader for respondents, on instructions, would submit that for issuance of online patta, it may be necessary for the petitioner to produce the manual patta, which stood in his name before the third respondent and if the petitioner submits the same, the representation dated 11.03.2024, made by petitioner would be considered and appropriate orders would be passed, within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner.
6. In view of the same, it is open to the petitioner to produce the manual patta, which stood in his name before the third respondent, the third respondent, shall consider the representation dated 11.03.2024, on its own merits and pass appropriate orders 4/7
in accordance with law, after affording reasonable opportunity of hearing to the petitioner, and any other interested persons/stake holders, within a period of six (6) weeks from the date of uploading of the web copy without waiting for the receipt of certified copy. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law.
7. Accordingly, the writ petition stands disposed of. There shall be no order as to costs.
