The wife has come before this Court seeking transfer of O.P. No. 2484 of 2014 filed by the respondent/husband for divorce before the II Additional Family Court, Chennai to the file of Additional Family court, Coimbatore where M.C.No. 136 of 2014 filed by the petitioner seeking maintenance is pending.

When the matter is called, the petitioner along with her parents and the respondent are present. Both the parties expressed their intention not to live together and they categorically stated that they seek divorce as per the settlement/separation agreement dated 08.01.2014 entered into between them. A joint memo of compromise dated 30.03.2015 is also filed, signed by both the parties and countersigned by the respective counsel, seeking divorce by mutual consent.

In view of the above development, no useful purpose will be served by keeping the divorce petition filed by the respondent/husband in O.P. No. 2484 of 2014 before the II Additional Family Court, Chennai and the maintenance case filed by the wife in https://hcservices.ecourts.gov.in/hcservices/
M.C. No. 136 of 2014 before the Additional Family Court, Coimbatore, pending. Considering their young age and also irretrievable breaking up of marriage, this Court grants a decree of divorce dissolving the marriage between the petitioner and the respondent which was solemnized on 29.09.2013. By this order, the divorce petition filed by the respondent in O.P. No. 2484 of 2014 on the file of II Additional Family Court, Chennai is ordered and the maintenance case in M.C.No. 136 of 2014 filed by the petitioner before the Additional Family Court, Coimbatore, is dismissed. The joint memo of compromise shall form part of the decree. The transfer C.M.P. is disposed of with the above directions. No costs. Connected M.P. is closed.
